Changes in Regulations

Council has made the following changes in regulations, to come into effect on 7 June.

(a) Security Subcommittee of the General Purposes Committee

Explanatory Note

The following changes establish a Security Subcommittee of the General Purposes Committee. The subcommittee will have formal oversight of the management of security risks across the University, including in relation to its staff and students, its infrastructure and its information. It is intended that, through the establishment of the subcommittee, Council will have more effective assurance that its security risks are being coherently and comprehensively managed; and that those individuals with responsibility in this area will both be better supported in their work and more effectively held to account for discharging their duties.

Text of Regulations

In Council Regulations 15 of 2002, concerning committees reporting directly to Council or one of its main committees, after Part 36 insert:

'Part 37: Security Subcommittee of the General Purposes Committee

1.1. The Security Subcommittee of the General Purposes Committee shall consist of:

(1) a Chair, appointed by Council;

(2) the Chair of the Buildings and Estates Subcommittee of the Planning and Resource Allocation Committee, or his or her nominee;

(3) the Chair of the Information Technology Committee, or his or her nominee;

(4) the Chair of the Personnel Committee, or his or her nominee;

(5) the Chair of the Education Committee, or his or her nominee;

(6) the Chair of the Health and Safety Management Committee, or his or her nominee;

(7)–(10) one person appointed by each of the divisional boards;

(11) the Pro-Vice-Chancellor with responsibility for Academic Services and University Collections, or his or her nominee;

(12) the Registrar, or his or her nominee;

(13) one person appointed by the Conference of Colleges;

(14) one of the Proctors or the Assessor as may be agreed between them;

(15) one external member with experience in the area of security of large organisations; and

(16) one member of the Council of the Oxford University Student Union elected by that Council.

1.2. Subject to the approval of Council on each occasion, the subcommittee may co-opt up to two additional members, who may be internal or external members.

1.3. The University Marshal, the Chief Information Officer, the Director of Human Resources, the Director of Biomedical Services and the Director of the Safety Office (or their nominees) shall normally be in attendance at the meetings of the subcommittee; other individuals shall be invited to attend as appropriate.  

1.4. The subcommittee shall be responsible for overseeing the management of the security risks to the University's staff and students, its infrastructure and its information, and it shall do so in a way that is proportionate to the threats.

1.5. In particular, the subcommittee shall:

(1) develop and maintain a University-wide security policy and framework and co-ordinate the implementation of that policy and framework across the University;

(2) oversee compliance with the University-wide security policy and framework and be responsible for providing assurance to other bodies as necessary;

(3) develop and maintain relevant security strategies to ensure the protection of the University's assets;

(4) at its discretion, consider any particular security threats and security incidents that may arise from time to time, determining what if any special measures should be taken to deal with those threats and incidents and overseeing the provision of any such special measures; and

(5) be responsible for developing and maintaining the University's emergency response processes, its disaster recovery processes and its business continuity framework.'

(b) Health and Safety Management Subcommittee of the General Purposes Committee

Explanatory Note

The following changes reconstitute the Health and Safety Management Committee as a subcommittee of the General Purposes Committee, but retain a reporting line directly to Council for items of business that are deemed to warrant Council's attention.

Text of Regulations

In Part 20 of Council Regulations 15 of 2002, concerning the Health and Safety Management Committee, delete existing regulation 20 and substitute (new text underlined, deleted text scored through):

'20.1. The Health and Safety Management SubcCommittee of the General Purposes Committee shall consist of:

(1) a member of Congregation appointed by the Vice-Chancellor as chairman of the committee;

(2) one of the Proctors and the Assessor as may be agreed between them;

(3) the Pro-Vice-Chancellor with responsibility for Academic Services and University Collections;

(4)–(7) the head of each division or his or her nominee;

(8), (9) two persons appointed by Council, taking into account the overall balance of the committee's membership;

(10) the Chair of the Security Subcommittee1.

20.2. The subcommittee may co-opt up to four additional members, who shall hold office for such period as the committee may determine.

20.3. The subcommittee shall be responsible for the following matters:

(1) the determination of the management strategy and policies necessary for the University to discharge its legal obligations in respect of occupational health and safety;

(2) the recommendation of appropriate action necessary to implement the University's Safety Policy, as designed to promote the safety of staff, students, authorised visitors, and members of the public lawfully on University property;

(3) the taking of action on all management matters of safety and occupational health and other areas of the committee's remit, including the control of such funds as may be allocated to it.

20.4.

(1) The subcommittee shall have the authority to take whatever action it deems necessary in relation to matters of health and safety where the committee considers practices to pose imminent potential danger or there to be a significant risk of enforcement action from appropriate authorities.

(2) The subcommittee may delegate the authority in paragraph (1) above, together with the associated decision-making, to its chair and/or to the Director of the Safety Office as it considers appropriate.

20.5. The subcommittee shall establish, implement and keep under review a procedure by which it will consider appeals from the relevant Head of Department against the exercise of the delegated authority under regulation 20.4 (2) above.

20.6. The subcommittee's remit shall include all matters covered by legislation on health and safety, fire safety, food safety, and the transport of dangerous goods, and by environmental protection legislation relating to the disposal of all hazardous wastes, radioactive substances, and genetic modification.

20.7. The subcommittee may set up such subcommittees and specialist advisory groups as it considers desirable, and shall determine their membership and terms of reference.

20.8. The subcommittee shall meet at least once a term, and following each meeting shall report to Council on the main matters which it has discussed; the committee shall also make an annual report to Council.

20.9. The subcommittee shall report as follows:

(1) following each meeting, the subcommittee shall report to General Purposes Committee on the principal matters which it has discussed;

(2) the subcommittee shall make an annual report to Council, which shall be considered in the first instance by General Purposes Committee prior to being forwarded to Council; and

(3) the subcommittee shall have the right to report directly to Council at any time on any matter which it regards as necessary to bring to the attention of Council.'
