COUNCIL OF THE UNIVERSITY

Changes in Regulations

Council has made the following changes in regulations, to come into effect on 18 December.

Explanatory Note

These changes bring the regulations concerning the Trustees of the University of Oxford Staff Pension Scheme into line with UK legislation and best practice of pension scheme management.

Text of Regulations

1 In Council Regulations 2 of 2004 (Supplement (2) to Gazette No. 4702, 30 June 2004), insert new Part 15 as follows:

'Part 15: Trustees of the University of Oxford Staff Pension Scheme

15.1. The University of Oxford Staff Pension Scheme, established under Deed of Trust ('the Trust Deed and Rules of the Scheme'), shall be administered in accordance with the terms of the Trust Deed and Rules of the Scheme by Trustees appointed in accordance with the provisions of the Trust Deed and Rules of the Scheme as follows:

(1)–(5) five persons appointed by Council;

(6)–(9) four persons who are members of the scheme (three of whom must be active contributing members and one of whom may be a pensioner member) nominated and elected by the active contributing membership of the scheme;

(10) a person who is a pensioner member of the scheme nominated and elected by the pensioner membership of the scheme;

(11) a person appointed by the Vice-Chancellor to be chairman, after consultation with the Trustees appointed or elected under paragraphs (1)–(10) above;

15.2. Each Trustee shall be appointed or elected for a period not exceeding three years and, subject to regulation 15.3 below, shall be eligible for reappointment or re-election at the end of such a period.

15.3. In accordance with the Trust Deed and Rules of the Scheme, a Trustee's term of office under regulation 15.2 above shall end before its appointed expiry date if the Trustee dies or upon the occurrence of any of the following events:

(a) in the case of any Trustee, if the Trustee serves one month's written notice on the University and the other Trustees that he or she wishes to resign or retire as a Trustee, in which case his or her term of office shall end upon the expiry of such notice (or such shorter period as the Trustees and the University may from time to time agree with the Trustee);

(b) in the case of a Trustee who has been appointed under paragraphs (1)–(5) of regulation 15.1 above, his or her removal by the University pursuant to its power under the Trust Deed and Rules of the Scheme;

(c) in the case of a Trustee who has been appointed under paragraphs (6)–(10) of regulation 15.1 above, his or her removal by the University pursuant to its power under the Trust Deed and Rules of the Scheme with the agreement of all the other Trustees;

(d) in the case of the chairman appointed under paragraph (11) of regulation 15.1 above, his or her removal by the decision of the Vice-Chancellor of the University notified in writing to the Trustees or his or her removal by the University pursuant to its power under the Trust Deed and Rules of the Scheme;

(e) in the case of a Trustee who was an active member at the time of his or her appointment under paragraphs (6)–(9) of regulation 15.1 above, if he or she ceases to be an active member (and does not immediately become a pensioner upon such cessation) in which case his or her term of office shall expire immediately upon his or her ceasing to be an active member unless the Trustees and the University agree otherwise; and

(f) in the case of a Trustee who was an active member at the time of his or her appointment under paragraphs (6)–(9) of regulation 15.1 above, if he or she ceases to be an active member and immediately becomes a pensioner at a time when there are already two pensioners who are Trustees, in which case his or her term of office shall expire immediately upon his or her ceasing to be an active member unless the Trustees and the University agree otherwise.

15.4. The conditions of the scheme, including qualifications for eligibility, rates of contributions and of benefits, and powers and duties of the Trustees and participating employers are laid down in the Trust Deed and Rules of the Scheme which may be amended only with the agreement of the Trustees and the approval of Council.'

CONGREGATION 1 December

1 Declaration of approval of Legislative Proposal: Trustees of the University of Oxford Staff Pension Scheme

2 Declaration of approval of Legislative Proposal: Statute VIII: Libraries, museums and scientific collections, and the University Press

No notice of opposition having been given, Mr Vice-Chancellor declared the Legislative Proposals (1) concerning the Trustees of the University of Oxford Staff Pension Scheme, and (2) amending Statute VIII approved.


3 Declaration of approval of Resolutions authorising the use of space at the Radcliffe Observatory Quarter

(i) That approximately 1,950 sq.m. of net usable space in the Gibson Building at the Radcliffe Observatory Quarter be temporarily allocated to the Mathematical Institute until the completion of the new Mathematical Institute.

(ii) That approximately 838 sq.m. of net usable space in the Harkness Building be temporarily allocated to the Ashmolean Museum until 31 December 2010.

(iii) That, in the event that the Joint Museums Store is not completed by 31 December 2010, Council may, on the recommendation of the Planning and Resources Allocation Committee of Council, review and extend the allocation under resolution (ii) above until the Store is completed or until 31 December 2011, whichever is the earlier date, without further recourse to Congregation.

(iv) That approximately 1,000 sq.m. of net usable space in the proposed Primary Care Trust Building on the Radcliffe Observatory Quarter be allocated to the Department of Primary Health Care.
