Degree by Resolution

The following resolution will be deemed to be approved at noon on 19 February, unless by that time the Registrar has received notice in writing from two or more members of Congregation that they wish the resolution to be put to a meeting of Congregation.

CONGREGATION 6 March 2 p.m.

¶ Members of Congregation are reminded that written notice of any intention to vote against the preamble of the statute at item 1 below, or of any intention to speak or ask a question concerning the Annual Review of the University at item 2 below, signed in each case by at least two members of Congregation, must be given to the Registrar by noon on Monday, 26 February (see the Guide to Procedures in Congregation cited in the note at the end of `University Agenda').

1 Promulgation of Statute

Statute: Removal of students from the Clinical Students' Register

Explanatory note

Graduation with the Degree of Bachelor of Medicine confers an automatic right to provisional registration with the General Medical Council. The General Medical Council has advised, and has agreed collectively with universities, that in order to protect patients there should be a means of preventing a student from continuing to study for such a degree if he or she is unfit to practise medicine. The following statute, and the decree to be made by Council if the statute is approved, accordingly make provision for the Medical Sciences Board to remove such a student, after due process, from the Clinical Students' Register. Opportunity is taken also to clarify the respective functions of the Medical and Clinical Students' Registers.

WHEREAS it is expedient to clarify the provisions governing the power of the Medical Sciences Board to remove a name from the Clinical Students' Register, THE UNIVERSITY ENACTS AS FOLLOWS.

In Tit. V, Sect. II, § 2 (Statutes, 2000, p. 39), delete cll. 3--4 and substitute:

`3. The Medical Sciences Board shall be responsible for maintaining a University Medical Students' Register of students admitted to work in Oxford for the First Examination for the Degree of Bachelor of Medicine, and shall make such regulations as it shall deem necessary for the discharge of such responsibility. No person shall be admitted to the First Examination for the Degree of Bachelor of Medicine unless his or her name is on the register.

4. The Medical Sciences Board shall also maintain a Clinical Students' Register of students admitted to work in Oxford for the Second Examination for the Degree of Bachelor of Medicine, other qualifying medical examinations, or the Preliminary Examination in Medicine, and shall make such regulations as it shall deem necessary for the discharge of this responsibility. No person shall be admitted to the Second Examination for the Degree of Bachelor of Medicine unless his or her name is on the register. The Medical Sciences Board is empowered to remove any name from such register (in the case of a matriculated member of the University, after consultation with the student's society). The grounds and procedures for removal and the associated regulations, if not previously approved by Council, and amendments to procedures and regulations previously so approved, shall be subject to the approval of the General Purposes Committee of Council.'


Decree to be made by Council if the Statute is approved

Breach of the Code of Conduct for Medical Students, as approved and from time to time amended by Council's General Purposes Committee on the recommendation of the Medical Sciences Board, may be deemed to be a ground for removal of a student's name from the Clinical Students' Register according to procedures which shall be approved from time to time by Council's General Purposes Committee on the recommendation of the Medical Sciences Board.'
