Degree by Special Resolution

No notice to the contrary having been received under the provisions of Tit. II, Sect. vi, cl. 6 (Statutes, 1995, p. 13), the following resolution is deemed to have been approved at noon on 4 December.

Explanatory note to Decree (1)

The following decree removes anomalies and makes consequential amendments to existing decrees which have been overlooked in recent legislation, and other minor amendments.

Decree (1)

1 In Ch. II, Sect. VIII, § 1, cl. 1 (3), concerning the Board of the Faculty of Clinical Medicine (Statutes, 1995, p. 239), after `Six official members elected' insert `from among those listed in the schedule to Sect. VI, § 1 and those qualified for official membership by virtue of holding posts on the establishment or under the aegis of the faculty board in any of the categories prescribed in Sect. VI, § 1, cl. 1 (2), who shall be elected'.

2 Ibid., Sect. X, item (1), concerning the Board of the Faculty of Physiological Sciences (p. 242), after `Sect. VI, § 1' insert `and those qualified for official membership by virtue of holding posts on the establishment or under the aegis of the faculty board in any of the categories prescribed in Sect. VI, § 1, cl. 1 (2)'.

[Clauses 1 and 2 above insert provisions governing elections of official members of the Clinical Medicine and Physiological Sciences Boards which were inadvertently omitted when the legislation governing such elections to other faculty boards was amended in 1992.]

3 In Ch. VIII, Sect. IV, FIRST SCHEDULE, item (2), concerning superannuation schemes (p. 512), delete `The Keeper and Deputy Keeper of the Archives.' and substitute:

`The Keeper of the Archives.'

[The post of Deputy Keeper of the Archives no longer exists.]

4 In Examination Decrees, 1995, p. 1048, l. 36, p. 1049, ll. 31 and 37, p. 1051, ll. 16, 25, and 37, and p. 1052, l. 5, in each case delete `cl. 13' and substitute `cl. 14'.

5 Ibid., p. 1049, l. 24, delete `cl. 12' and substitute `cl. 13'.

[Clauses 4 and 5 above correct cross-references in the legislation governing composition fees which were overlooked when a new clause was inserted last Hilary Term.]

[These references in the fees legislation to the Special Diploma in Educational Studies were overlooked when the title of the qualification was changed last Trinity Term to Postgraduate Diploma in Educational Studies.]

Explanatory note to Decree (2)

Council has recently reviewed the arrangements for association of university lecturerships and professorships with single-sex colleges and has decided that, for the future, not only will a mixed college be able to offer a fellowship to a successful male candidate, need to be associated with the appointment (under the provisions of Ch. VII, Sect. II, cl. 6, Statutes 1995, p. 374) but also the law requires that a woman appointed to such a post should have the right to choose between the two college associations. The following decree amends the legislation governing the allocation of professorships and the proceedings of electoral boards accordingly.

Decree (2)

1 In Ch. VII, Sect. I, § 2, cl. 6, concerning elections to professorships (Statutes, 1995, p. 353), after `both sexes' insert `, or women candidates alone,'.

2 Ibid., delete the final sentence and substitute: `If during the course of the election only men candidates remain under consideration, the electors from the college open to men and women shall have one vote each and the electors from the women's college shall not be entitled to vote.'

3 Ibid., Sect. II, concerning the allocation of professorships (Statutes, 1995, p. 374), insert new cl. 7 as follows and renumber existing cll. 7 and 8 (pp. 374–5) as cll. 8 and 9:

`7. In the event of a woman being elected or appointed to a professorship allocated or to be allocated under the provisions of this decree to a woman's college but desiring to hold the professorship at the college specified under clause 6 above, Council shall allocate the professorship to that college for the period of her tenure thereof; and from and after the termination of her tenure, the professorship shall forthwith, by virtue of this decree, again be allocated to the college to which it was allocated immediately before her election or appointment thereto.'

Explanatory note to Decree (3)

The following decree, made on the recommendation of the Management Committee for the Winchester and Pavry Memorial Lecturerships and with the concurrence of the General Board, provides that visiting lecturers appointed under this scheme should lecture in a given subject rather than being required specifically to give one lecture: this is to provide greater flexibility so that, for instance, a lecturer might be required to give two or more talks if thought desirable in a particular case. The decree also provides that surplus income may be invested in augmentation of the capital if this seems to the committee desirable, for as long as that is permissible in law.

Explanatory note to Decree (4)

The following decree, made on the recommendation of the Committee for the School of Management Studies and with the concurrence of the General Board, adds the Postgraduate Diploma in Management Studies to the list of courses for which a composition fee is payable and sets the 1995–6 fee for the course at £250.

Decree (5)

Dispensation from prescribed duties is granted to D.I. Stuart, MA (B.Sc. London, Ph.D. Bristol), Fellow of Hertford College and University Lecturer in Structural Molecular Biology, for five years from 1 October 1995 to enable him to hold an MRC Non-Clinical Research Professorship.
